A fifth wheel or travel trailer doesn’t have the motorized chassis covered by the new-motor-vehicle definition, but defects may still warrant review under California’s broader consumer warranty protections.

When an RV Defect May Qualify for Lemon Law Relief

A qualifying defect must substantially impair the RV’s use, value, or safety and remain unresolved after a reasonable number of repair attempts. What counts as reasonable depends on the seriousness of the defect, the repair history, and how long the vehicle was unavailable.

The Tanner Consumer Protection Act creates a legal presumption for qualifying new motor vehicles during the first 18 months or 18,000 miles. Common thresholds include two repair attempts for a defect likely to cause death or serious bodily injury, four attempts for the same non-safety defect, or more than 30 cumulative days out of service. Falling short of those thresholds doesn’t automatically defeat a claim.
